RESERVATION AGREEMENT FOR
LANSBROOK LAKEFRONT PARK PAVILION

    A signed copy of this Agreement must be received in the Melrose Management Group office within five (5) days after the reservation is made.

    This Reservation Agreement for Lansbrook Lakefront Park Pavilion (this "Agreement") is entered into and effective as of the acceptance date specified below, between the Undersigned and Lansbrook Master Association, Inc (the "Association").

    RECITALS

    1. The Undersigned has requested that the Association allow the Undersigned and the Undersigned’s guests to use the Pavilion located in the Lansbrook Lakefront Park and its facilities.

    2. The Association is willing to grant the Undersigned the right to use the Park, subject to the terms of this Agreement and the Park’s rules relating to reservations of its use, a copy of which is attached. No skateboards are permitted in the Lakefront Park area. No waterslides or “moonwalks” are permitted in Lakefront Park.

    STATEMENT OF THE AGREEMENT

    1. RIGHT TO USE. The Association hereby grants permission to the Undersigned and the Undersigned's guests to utilize the Park on an exclusive basis on ___/___/___ during the hours of ___:___ AM/PM to ___:___ AM/PM for the folowing purpose:

      All those individuals who will use the Park in connection with the event for which the Undersigned has reserved the Park (the "Event") shall be considered the guests.

    2. FEE. A non-refundable Usage Fee of $50.00 is required upon the execution of this Agreement by the Undersigned, if 25 or more people will be in attendance.

    3. DEPOSIT. A Reservation Damage Deposit (the "Deposit") in the amount of $250.00 is required upon the execution of this Agreement. The Deposit will be refunded if this Agreement is not accepted by the Association. After the completion of the Event, the Association will inspect the Park. If any part of the Park was damaged or requires cleaning or maintenance as a result of the Event, or if trash is not properly placed in dumpster, the Deposit (or any part thereof) will be applied to the cost of any necessary repairs, replacements, maintenance, or cleaning. In the event the Deposit is not sufficient to cover such costs the Undersigned agrees to pay to the Association within fifteen (15) days after demand, any addiitional sums necessary.

    4. GATE ACCESS CODE. The Undersigned agrees that a gate access code will be assigned for the date and time of the Event, and will be provided at least five (5) days in advance of the Event. The Undersigned further agrees that he/she will accept full responsibility for advising attendees of the Event regarding the access code prior to the date of the Event. THE ACCESS CODE MAY NOT BE POSTED on or around the entry gate. In the event that the code is found posted in the entry area, the Association will remove the posting and the Undersigned will be charged a $50.00 fee to be deducted from the deposit.

    5. INSURANCE. The Association reserves the right to require, as a condition of its acceptance of this Agremeent, evidence of insurance satisfactory to the Association in its sole discretion covering potential liability arising out of the Event.

    6. MAINTENANCE. It is the responsibility of the Undersigned to leave the Park and Pavilion in a neat and clean condition with all garbage and rubbish properly disposed of in the dumpster located in the Park.

    7. RISK OF USE ON USER. Use of the Park is at the user's own risk at all times. The Association does not assume any liability for accidents or injury to persons, or loss of, or damage to property.

    8. INDEMNIFICATION. The Undersigned shall indemnify, defend, protect and hold the Association and its officers, directors and members harmless from and against any and all demands, claims, actions, proceedings, losses, damages, liabilities, costs or expenses (including attorneys' fees) arising or resulting from any injury to person or damage to or loss of property arising from or in connection with the Event or Undersigned and his guests use of the Park.

    9. RELEASE FROM LIABILITY. The Undersigned hereby releases the Association and its officers, directors and members from all liability in connection with the reservation of the Park and its use for the Event and waives all claims against the Association, its officers, directors and members arising out of any injury to person or damage to or loss of property occurirng in connection with the Event.
